THE PEOPLE OF THE STATE OF CALIFORNIA, Plaintiff vs T.S., Defendant

This Court, having heard the evidence adducedat trial finds as follows:

Upon weighing of the evidence, this Court finds that the People have established that on or about December 4, 2005 the Defendant did kill the decedent.  However, the state of the evidence submitted at the close of the prosecution's case is such that this Court is not convinced beyond all reasonable doubt that the homocide inflicted by Defendant was unjustified,  Specifically, this Court is not convinced beyond a reasonable doubt that the killing was not committed in the defense of others.  For that reason, this Court orders the entry of a judgement of acquittal on thew sole charge of Penal Code Section 187, murder in the first degree.

Defendant is hereby acquitted of that charge and this matter is dismissed.

GOOD CAUSE APPEARING THEREFORE, IT IS HEREBY ORDERED that the Defendant be ACQUITTED of the allegation of MURDER and this case is dismissed.

Mr. Wise represented me through trial in February 2007.  To that end, I was acquitted of all charges after jury trial.
